Anderson Property Investment Group Pty Ltd (ABN 16 163 397 546, ACN 163 397 546) trading as Jay Anderson Property ("we", "us", "our") is committed to complying with our obligations under the Privacy Act 1988 (Cth) (the Act), including the Australian Privacy Principles (APPs).

 

The Act allows personal information to be collected, used and disclosed for the purposes for which it was collected, in accordance with the Act.

 

This Privacy Policy applies to personal information we collect and hold in connection with our buyers agency services and this website.

 

This Privacy Policy may be revised, updated or replaced from time to time. Any changes take effect from the date the updated policy is posted to this website.

 

What information do we collect?

We may collect personal information including your name, contact details (email, phone, address), property preferences and budget, and information you provide when engaging us to act as your buyers agent — including information you submit through our contact or enquiry forms.

 

Why do we collect this information?

We collect and use personal information to:

 

  • respond to your enquiry and provide our buyers agency services;

  • identify and assess properties on your behalf;

  • liaise and exchange information with selling agents, vendors, financiers, conveyancers/solicitors and other advisors in connection with a property search or purchase;

  • negotiate and manage a property purchase on your behalf;

  • manage our client records and provide ongoing service and updates;

  • comply with any applicable law; and

  • tell you about other services we provide, unless you tell us not to (this is direct marketing).


Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF)

As a real estate professional, we are subject to obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (AML/CTF Act). At the time we engage with you as a client, we collect and verify identity information in order to meet these obligations, including:

 

  • Primary photo identification — driver licence, passport, or foreign passport (verified automatically, usually within minutes);

  • Secondary identity documents (a minimum of two) — such as a Medicare card, citizenship certificate, marriage certificate, birth certificate, change of name certificate, concession card or veteran card (verified manually, which may take longer); and

  • Supporting documents confirming your address or employment, generally issued within the last 3 months — such as a utility bill, bank statement, council rates notice, government notice, ATO notice (within the last 12 months), or payslip/employer letter.


Where the standard documents above aren't available, we can accept alternative supporting documents on request.

We use Pexa Clear, a third-party identity verification service, to carry out this process. We limit the collection of this information to what is reasonably necessary to meet our AML/CTF obligations, and it is handled in accordance with this Privacy Policy.

Automated Decision Making (ADM)

We do not use automated decision making that would significantly affect your rights or interests.

How we collect personal information

We collect personal information directly from you — for example, when you complete an enquiry or contact form on this website, call or email us, or engage us as your buyers agent. We may also collect information from other sources where reasonably necessary, such as selling agents, publicly available property data, and other advisors involved in a transaction.

Information disclosed

We will use and disclose personal information only for the purposes for which it was collected, including:

 

  • providing our services and client support;

  • maintaining and updating our records;

  • comparing information for accuracy and verifying it with third parties;

  • liaising with selling agents, financiers, conveyancers and other professionals involved in a property transaction on your behalf; and

  • providing information as authorised or required by law or a relevant government authority.


We do not sell your personal information.

Overseas disclosure

We use cloud storage, client management and IT services that may store or process information overseas. To the extent we can identify the countries involved, they are:

 

  • United States — via our website analytics provider (Google Analytics), our client relationship management platform (HubSpot), our project/task management tool (Asana), and our cloud storage provider (Google Drive).

  • Israel — this website is hosted on the Wix.com platform, which may also use hosting infrastructure in other countries as part of its global network.


Please note that some countries we transfer information to may not have privacy laws offering protections equivalent to the Australian Privacy Principles, and there may be no local mechanism available to you to enforce those protections directly.

Cookies and website analytics

This website uses cookies, including through Google Analytics, to understand how visitors use the site (e.g. pages viewed, time on site, referring website). This information is used for internal statistical analysis and to improve the website. You can control or disable cookies through your browser settings, though this may affect how the site functions.

Anonymity and pseudonyms

General visitors to this website do not need to identify themselves to browse the site. However, if you wish to engage us as your buyers agent, we will generally be unable to act for you anonymously or under a pseudonym, as this is necessary to properly represent you in a property transaction.

Information security

We take reasonable steps to protect personal information we hold from misuse, loss, unauthorised access, modification or disclosure, including secure IT systems and access controls. No transmission of information over the internet can be guaranteed completely secure, and we do not warrant the security of information transmitted to us online.

Links to other websites

This website may contain links to other websites. We are not responsible for the privacy practices or content of those third-party sites, and this Privacy Policy does not extend to them.

Marketing and opt-out

We may use your personal information (excluding sensitive information) to keep you informed of properties, services or updates we consider may be of interest to you, unless you tell us not to. You can opt out at any time by contacting our Privacy Officer below, or via the unsubscribe link in any marketing email. We will not use sensitive information for marketing purposes without your consent.

Accessing and correcting your personal information

You may request access to the personal information we hold about you, or request correction of information that is inaccurate, incomplete or out of date. Requests should be made in writing to our Privacy Officer below. We may charge a reasonable fee for providing access in some circumstances.
